This amendment rescinds airworthiness directive (AD) 2009-18- 19 for the products listed above. This AD results from mandatory continuing airworthiness information (MCAI) issued by EASA, to rescind EASA AD 2010-0083. The MCAI specifies the following: \n\n\n\tIt has been assessed that multiple NRV (non-return valve) failures in combination with certain trapped fuel cases could potentially increase the quantity of unusable fuel on the aeroplane, possibly leading to fuel starvation which could result in engines in-flight shut down and would constitute an unsafe condition. To prevent and detect this condition, EASA issued EASA AD 2010-0083. \n\tBased on in service experience, mainly on the results of the operational test required by \n\n((Page 33987)) \n\nEASA AD 2010-0083, Airbus has performed a safety analysis on the NRV to check if the safety objectives are met. \n\tThis analysis of the Collector Cell motive flow line NRV, taking into account all failure scenarios, concludes thatthe previous non compliance can be alleviated. Consequently, no unsafe condition exists any more on the affected NRV. \n\tFor the reasons described above, EASA AD 2010-0083 is cancelled. \n\n\n\tThis AD rescinds the parallel FAA AD 2009-18-19.

Discussion\n\n We issued a notice of proposed rulemaking (NPRM) to amend 14 CFR \npart 39 by rescinding an existing AD. That NPRM was published in the \nFederal Register on December 30, 2010 (75 FR 82325) and proposed to \nrescind AD 2009-18-19, Amendment 39-16016 (74 FR 46322, September 9, \n2009). That AD was intended to address an unsafe condition on the \nproducts listed above.\n Since we issued AD 2009-18-19, EASA issued Airworthiness Directive \n2010-0083-CN, dated September 20, 2010, to cancel EASA AD 2010-0083, \ndated May 3, 2010, for the specified products. EASA AD 2010-0083-CN \nstates:\n\n It has been assessed that multiple NRV (non-return valve) \nfailures in combination with certain trapped fuel cases could \npotentially increase the quantity of unusable fuel on the aeroplane, \npossibly leading to fuel starvation which could result in engines \nin-flight shut down and would constitute an unsafe condition. You may obtain \nfurther information by examining the MCAI in the AD docket.\n\nComments\n\n We gave the public the opportunity to participate in developing \nthis AD. We received no comments on the NPRM or on the determination of \nthe cost to the public.\n\nConclusions\n\n We reviewed the available data and determined that air safety and \nthe public interest require the rescission of the ADas proposed.\n\nDifferences Between This AD and the MCAI or Service Information\n\n We have reviewed the MCAI and, in general, agree with the \nsubstance. But we might have found it necessary to use different words \nfrom those in the MCAI to ensure the AD is clear for U.S. operators and \nis enforceable. In making these changes, we do not intend to differ \nsubstantively from the information provided in the MCAI.\n\nRegulatory Findings\n\n We determined that this AD would not have federalism implications \nunder Executive Order 13132. This AD would not have a substantial \ndirect effect on the States, on the relationship between the national \ngovernment and the States, or on the distribution of power and \nresponsibilities among the various levels of government.\n For the reasons discussed above, I certify that this AD:\n (1) Is not a ''significant regulatory action'' under Executive \nOrder 12866,\n (2) Is not a ''significant rule'' under DOT Regulatory Policies andProcedures (44 FR 11034, February 26, 1979),\n (3) Would not have a significant economic impact, positive or \nnegative, on a substantial number of small entities under the criteria \nof the Regulatory Flexibility Act.\n\nExamining the AD Docket\n\n You may examine the AD docket on the Internet at http://www.regulations.gov; or in person at the Docket Operations office \nbetween 9 a.m. and 5 p.m., Monday through Friday, except Federal \nholidays.
