The Amendment \n\n\n\tAccordingly, under the authority delegated to me by the Administrator, the FAA amends 14 CFR part 39 as follows: \n\nPART 39--AIRWORTHINESS DIRECTIVES \n\n0 1. The authority citation for part 39 continues to read as follows: \n\n\n\tAuthority: 49 U.S.C. 106(g), 40113, 44701. \n\n\n\nSec. 39.13 (Amended) \n\n0 2. The FAA amends Sec. 39.13 by adding the following new airworthiness directive: \n\n2021-17-01 Austro Engine GmbH: Amendment 39-21684; Docket No. FAA- 2021-0654; Project Identifier MCAI-2021-00682-E. \n\n(a) Effective Date \n\n\n\tThis airworthiness directive (AD) is effective August 23, 2021. \n\n(b) Affected ADs \n\n\n\tNone. \n\n(c) Applicability \n\n\n\tThis AD applies to Austro Engine GmbH E4 and E4P model diesel piston engines. \n\n(d) Subject \n\n\n\tJoint Aircraft System Component (JASC) Code 8550, Reciprocating Engine Oil System. \n\n(e) Unsafe Condition \n\n\n\tThis AD was prompted by a report of oil pressure loss on an E4 model diesel piston engine. The FAA is issuing this AD to prevent failure of the engine. The unsafe condition, if not addressed, could result in failure of the engine, in-flight shutdown, and loss of the airplane. \n\n(f) Compliance \n\n\n\tComply with this AD within the compliance times specified, unless already done. \n\n(g) Required Actions \n\n\n\tBefore further flight after the effective date of this AD, remove the oil pump, part number (P/N) E4A-50-000-BHY, with a serial number (S/N) listed in paragraph 1.2., Engines Affected, Tables 2 and 3, of Austro Engine GmbH Mandatory Service Bulletin No. MSB-E4- 031/1, Revision No. 1, dated July 1, 2021 (the MSB), from service and replace with a part eligible for installation using the Accomplishment/Instructions, paragraph 2.2.1 or paragraph 2.2.2., of the MSB, as applicable. \n\n(h) No Communication or Reporting Requirements \n\n\n\tThe instructions to contact the manufacturer and report information to the manufacturer in the Accomplishment/Instructions, paragraph 2.2, of the MSB, are not required by this AD. \n\n(i) Installation Prohibition \n\n\n\tAfter the effective date of this AD, do not install onto any engine an oil pump with P/N E4A-50-000-BHY and an S/N listed in paragraph 1.2., Engines Affected, Tables 2 and 3, of the MSB. \n\n(j) Definitions \n\n\n\tFor the purpose of this AD, a ''part eligible for installation'' is an oil pump that is not P/N E4A-50-000-BHY or an oil pump P/N E4A-50-000-BHY and an S/N that is not listed in paragraph 1.2., Engines Affected, Tables 2 and 3, of the MSB. \n\n(k) Special Flight Permit \n\n\n\tSpecial flight permits, as described in Section 21.197 and Section 21.199 of the Federal Aviation Regulations (14 CFR 21.197 and 21.199), are subject to the requirements of paragraph (k)(1) and (2) of this AD. \n\t(1) Operators of a twin-engine airplane that has one or two Model E4 engines in configuration ''-B'' or ''-C'' or Model E4P engines installed may perform a one-time non-revenue ferry flight to a location where the engine can be removed from service. This ferry flight must be performed with only essential flight crew. \n\t(2) All other ferry flights are prohibited. \n\n(l) Alternative Methods of Compliance (AMOCs) \n\n\n\t(1) The Manager, ECO Branch, FAA, has the authority to approve AMOCs for this AD, if requested using the procedures found in 14 CFR 39.19. In accordance with 14 CFR 39.19, send your request to your principal inspector or local Flight Standards District Office, as appropriate. If sending information directly to the manager of the ECO Branch, send it to the attention of the person identified in Related Information.
