Adoption of the Amendment \n\n\n\tAccordingly, under the authority delegated to me by the Administrator, the FAA amends 14 CFR part 39 as follows: \n\nPART 39--AIRWORTHINESS DIRECTIVES \n\n0 1. The authority citation for part 39 continues to read as follows: \n\n\n\tAuthority: 49 U.S.C. 106(g), 40113, 44701. \n\n\n\nSec. 39.13 (Amended) \n\n0 2. The FAA amends Sec. 39.13 by adding the following new airworthiness directive: \n\n2020-25-08 Yabora Industria Aeronautica S.A. (Type Certificate Previously Held by Embraer S.A.): Amendment 39- 21350; Docket No. FAA-2020-0842; Product Identifier 2020-NM-101-AD. \n\n(a) Effective Date \n\n\n\tThis airworthiness directive (AD) is effective January 21, 2021. \n\n(b) Affected ADs \n\n\n\tNone. \n\n(c) Applicability \n\n\n\tThis AD applies to Yabora Industria Aeronautica S.A. Model airplanes identified in paragraphs (c)(1) and (2) of this AD, certificated in any category. \n\t(1) Model ERJ 170-100 LR, -100 STD, -100 SE, -100 SU, -200 LR, - 200 SU, -200 STD, and -200 LL airplanes, as identified in Agencia Nacional de Aviacao Civil (ANAC) AD 2020-05-01, effective May 26, 2020 (ANAC AD 2020-05-01). \n\t(2) Model ERJ 190-100 STD, -100 LR, -100 ECJ, -100 IGW, -200 STD, -200 LR, and -200 IGW airplanes, as identified in ANAC AD 2020- 05-02, effective May 26, 2020 (ANAC AD 2020-05-02). \n\n(d) Subject \n\n\n\tAir Transport Association (ATA) of America Code 27, Flight controls. \n\n(e) Reason \n\n\n\tThis AD was prompted by reports of installation of inverted poles of the horizontal stabilizer pitch trim switches on the control yokes, which causes opposite commands for the horizontal stabilizer. The FAA is issuing this AD to address this condition, which could result in reduced controllability of the airplane. \n\n((Page 81383)) \n\n(f) Compliance \n\n\n\tComply with this AD within the compliance times specified, unless already done. \n\n(g) Requirements \n\n\n\tExcept as specified in paragraph (h) of this AD: Comply with all required actions and compliance times specified in, and in accordance with, ANAC AD 2020-05-01 and ANAC AD 2020-05-02, as applicable. \n\n(h) Exceptions to ANAC AD 2020-05-01 and ANAC AD 2020-05-02 \n\n\n\t(1) Where ANAC AD 2020-05-01 and ANAC AD 2020-05-02 refer to their effective date, this AD requires using the effective date of this AD. \n\t(2) The ''Alternative method of compliance (AMOC)'' section of ANAC AD 2020-05-01 and ANAC AD 2020-05-02 does not apply to this AD. \n\t(3) Where ANAC AD 2020-05-01 and ANAC AD 2020-05-02 prohibit installing certain parts, this AD prohibits their installation as of the applicable compliance time specified by paragraph (h)(3)(i) or (ii) of this AD. \n\t(i) If the modification required by this AD was done before the effective date of this AD, installation is prohibited as of the effective date of this AD. \n\t(ii) If the modification required by this AD is done after the effective date of this AD, installation is prohibited after accomplishment of the modification required by this AD. \n\n(i) No Reporting Requirement \n\n\n\tAlthough the service information referenced in ANAC AD 2020-05- 01 and ANAC AD 2020-05-02 specifies to submit certain information to the manufacturer, this AD does not include that requirement. \n\n(j) Other FAA AD Provisions \n\n\n\tThe following provisions also apply to this AD: \n\t(1) Alternative Methods of Compliance (AMOCs): The Manager, Large Aircraft Section, International Validation Branch, FAA, has the authority to approve AMOCs for this AD, if requested using the procedures found in 14 CFR 39.19. In accordance with 14 CFR 39.19, send your request to your principal inspector or local Flight Standards District Office, as appropriate. If sending information directly to the Large Aircraft Section, International Validation Branch, send it to the attention of the person identified in paragraph (k) of this AD. Information may be emailed to: 9-AVS-AIR-730-AMOC@faa.gov. Before using any approved AMOC, notify your appropriate principal inspector, or lacking a principal inspector, the manager of the local flight standards district office/ certificate holding district office. \n\t(2) Contacting the Manufacturer: For any requirement in this AD to obtain instructions from a manufacturer, the instructions must be accomplished using a method approved by the Manager, Large Aircraft Section, International Validation Branch, FAA; or ANAC; or ANAC's authorized Designee.
