Adoption of the Amendment \n\n\n\tAccordingly, under the authority delegated to me by the Administrator, the FAA amends 14 CFR part 39 as follows: \n\nPART 39--AIRWORTHINESS DIRECTIVES \n\n0 1. The authority citation for part 39 continues to read as follows: \n\n\n\tAuthority: 49 U.S.C. 106(g), 40113, 44701. \n\n\n\nSec. 39.13 (Amended) \n\n0 2. The FAA amends Sec. 39.13 by adding the following new airworthiness directive (AD): \n\n2020-12-12 Yabor(atilde) Ind(uacute)stria Aeron(aacute)utica S.A. (Type Certificate previously held by Embraer S.A.) Airplanes: Amendment 39-19921; Docket No. FAA-2020-0202; Product Identifier 2020-NM-025-AD. \n\n(a) Effective Date \n\n\n\tThis AD is effective August 13, 2020. \n\n(b) Affected ADs \n\n\n\tNone. \n\n(c) Applicability \n\n\n\tThis AD applies to all Yabor(atilde) Ind(uacute)stria Aeron(aacute)utica S.A. (Type certificate previously held by Embraer S.A.) airplanes specified in paragraphs (c)(1) and (2) of this AD, certificated in any category.(1) Model ERJ 170-100 LR, -100 STD, -100 SE, -100 SU, -200 LR, - 200 SU, -200 STD, and -200 LL airplanes. \n\t(2) Model ERJ 190-100 STD, -100 LR, -100 ECJ, -100 IGW, -200 STD, -200 LR, and -200 IGW airplanes. \n\n((Page 41177)) \n\n(d) Subject \n\n\n\tAir Transport Association (ATA) of America Code 54, Nacelles/ pylons. \n\n(e) Reason \n\n\n\tThis AD was prompted by reports of cracking on the left-hand (LH) and right-hand (RH) sides of engine pylon inboard lower link lugs. The FAA is issuing this AD to address cracking of the engine pylon lower link lugs, which could cause the loss of engine pylon integrity, and could result in engine separation from the wing, loss of airplane controllability, and possible injury to persons on the ground. \n\n(f) Compliance \n\n\n\tComply with this AD within the compliance times specified, unless already done. \n\n(g) Requirements \n\n\n\tExcept as specified in paragraph (h) of this AD: Comply with all required actions and compliance times specified in, andin accordance with, Ag(ecirc)ncia Nacional de Avia(ccedil)(atilde)o Civil (ANAC) AD 2020-01-02, effective January 28, 2020 (''ANAC AD 2020-01-02''). \n\n(h) Exceptions to ANAC AD 2020-01-02 \n\n\n\t(1) Where ANAC AD 2020-01-02 refers to its effective date, this AD requires using the effective date of this AD. \n\t(2) Where ANAC AD 2020-01-02 requires contacting ''ANAC and Embraer . . . to approve an adequate repair,'' for this AD, obtain repair instructions using the procedures specified in paragraph (i)(2) of this AD and do the repair. \n\t(3) The ''Alternative methods of compliance (AMOCs)'' section of ANAC AD 2020-01-02 does not apply to this AD. \n\t(4) Paragraph (e) of ANAC AD 2020-01-02 specifies to report inspection results to ANAC and Yabor(atilde) Ind(uacute)stria Aeron(aacute)utica S.A. within a certain compliance time. For this AD, report inspection results at the applicable time specified in paragraph (h)(4)(i) or (ii) of this AD. \n\t(i) If the inspection was done on or afterthe effective date of this AD: Submit the report within 30 days after the inspection. \n\t(ii) If the inspection was done before the effective date of this AD: Submit the report within 30 days after the effective date of this AD. \n\n(i) Other FAA AD Provisions \n\n\n\tThe following provisions also apply to this AD: \n\t(1) Alternative Methods of Compliance (AMOCs): The Manager, Large Aircraft Section, International Validation Branch, FAA, has the authority to approve AMOCs for this AD, if requested using the procedures found in 14 CFR 39.19. In accordance with 14 CFR 39.19, send your request to your principal inspector or local Flight Standards District Office, as appropriate. If sending information directly to the Large Aircraft Section, International Validation Branch, send it to the attention of the person identified in paragraph (j) of this AD. Information may be emailed to: 9-ANM-116-AMOC-REQUESTS@faa.gov. Before using any approved AMOC, notify your appropriate principal inspector,or lacking a principal inspector, the manager of the local flight standards district office/ certificate holding district office. \n\t(2) Contacting the Manufacturer: For any requirement in this AD to obtain instructions from a manufacturer, the instructions must be accomplished using a method approved by the Manager, Large Aircraft Section, International Validation Branch, FAA; or ANAC; or ANAC's authorized Designee. If approved by the ANAC Designee, the approval must include the Designee's authorized signature. \n\t(3) Required for Compliance (RC): For service information that contains steps that are labeled as RC, the provisions of paragraphs (i)(3)(i) and (ii) of this AD apply. \n\t(i) The steps labeled as RC, including substeps under an RC step and any figures identified in an RC step, must be done to comply with the AD. If a step or substep is labeled ''RC Exempt,'' then the RC requirement is removed from that step or substep. An AMOC is required for any deviations to RC steps, including substeps and identified figures. \n\t(ii) Steps not labeled as RC may be deviated from using accepted methods in accordance with the operator's maintenance or inspection program without obtaining approval of an AMOC, provided the RC steps, including substeps and identified figures, can still be done as specified, and the airplane can be put back in an airworthy condition. \n\t(4) Paperwork Reduction Act Burden Statement: A federal agency may not conduct or sponsor, and a person is not required to respond to, nor shall a person be subject to a penalty for failure to comply with a collection of information subject to the requirements of the Paperwork Reduction Act unless that collection of information displays a current valid OMB Control Number. The OMB Control Number for this information collection is 2120-0056. Public reporting for this collection of information is estimated to be approximately 1 hour per response, including the time for reviewing instructions, searching existing data sources, gathering and maintaining the data needed, and completing and reviewing the collection of information. All responses to this collection of information are mandatory as required by this AD.
